In Elder Law News

In most states, IRAs are counted like any other assets. But that differs somewhat from state to state, so you’ll have to check with your local Medicaid agency or a local elder law attorney to be certain.

If the IRAs are countable, your IRA will be countable as well. However, it might not matter. While your husband is limited to $2,000 in countable assets, you can keep as much as much as $137,400 (in 2022).

One more thing you need to know about IRA. Your husband can transfer assets to you to get under the $2,000 threshold. Unfortunately, he would have to liquidate his IRA before transferring. When he does that, it will all be taxable.
